1. Acceptance of Terms

By accessing or using PhotoQuill, you agree to these Terms of Service. If you do not agree, you should not use the service.

2. Accounts and Eligibility

You must provide accurate account information, keep your login credentials secure, and remain responsible for activity under your account. You may use PhotoQuill only if doing so is lawful in your jurisdiction and you are permitted to use services of this kind.

3. Credits, Billing, and Renewals

PhotoQuill uses a credit-based system for AI generation features. Free accounts may receive daily credits, while paid plans and top-ups provide additional usage. Subscriptions renew automatically until cancelled. Current plan details appear on the pricing page, and refund eligibility is described in the refund policy.

4. Intellectual Property and Generated Content

You keep ownership of the images and project content you create or upload through PhotoQuill, subject to any rights held by third-party source material you provide. You give us a limited license to host, process, transmit, and display that content only to the extent needed to operate the service, such as generation, editing, caching, delivery, support, and account history.

5. Acceptable Use Policy

PhotoQuill is a general-purpose creative tool. When using any AI generation, editing, or upload feature, you agree to the following Acceptable Use Policy. Violations may result in immediate account suspension or termination without refund.

Strictly prohibited content and activities include:

• NSFW, sexually explicit, or pornographic content of any kind. This includes, without limitation, nudity, sexual acts, sexually suggestive depictions, "implied nudity," fetish content, and any adult-oriented material — whether generated, uploaded, edited, or distributed using PhotoQuill. Prompts attempting to circumvent this rule (including obfuscated, coded, or euphemistic language) are equally prohibited.
• Child sexual abuse material (CSAM) or any content sexualizing minors. Zero tolerance. Violations are reported to relevant authorities including NCMEC where required by law.
• Non-consensual intimate imagery, including deepfakes, "nudify"-style transformations, or any sexual depiction of real identifiable individuals without their express consent.
• Hate speech, harassment, incitement to violence, or content targeting individuals or groups based on protected characteristics.
• Violent, graphic, or disturbing content glorifying harm, gore, self-harm, suicide, terrorism, or extremist propaganda.
• Illegal content or activity, including drug trafficking, weapons manufacturing, counterfeit goods, fraud, and infringement of intellectual-property or privacy rights.
• Deceptive impersonation, misinformation, malware, phishing, or attempts to bypass our safety, billing, rate-limit, or authentication controls.

All text prompts submitted to our AI generation endpoints are screened in real time by an automated content-safety system (Creem Moderation API) before the request reaches any model provider. Requests that fail this screening are rejected and no credits are charged. We may also review generations, account activity, and user reports to enforce this policy.

6. Service Availability

We work to keep PhotoQuill reliable and available, but we do not guarantee uninterrupted access, error-free operation, or permanent availability of every feature, model, plan, or usage limit. We may change or discontinue parts of the service over time.

7. Limitation of Liability

To the fullest extent allowed by law, PhotoQuill is provided on an "as is" and "as available" basis. We disclaim warranties and are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
